Terms and Conditions - O2 Forum

O2 provides this forum as a service to its customers only to help them exchange information and comment on O2 services.  These terms and conditions are in addition to and not in substitution for the General Terms (as hereinafter defined) and the rules of use set out in the O2 Forum Guidelines.   By registering to use and contribute comments to the O2 Forum you the Customer agree to be bound by these terms and conditions, the General Terms, the O2 Forum Guidelines and any and all O2 Acceptable Use and Privacy Policies and such other terms and conditions of use as O2 in its absolute discretion may decide from time to time.

1. Definitions and Interpretation

1.1. "Acceptable Use" means the acceptable use policy described at Section 12 of the terms and conditions for O2.ie, which are available at www.O2.ie/terms.

1.2. "Content" means any comment, username, links or images submitted by the Customer to the O2 Forum.

1.3. "Customer" means a customer of O2 who is registered with the O2 Forum.

1.4. "General Terms" means the general terms and conditions for the use of O2 wireless services, and which are available at [www.O2.ie/terms.], including but not limited to the terms and conditions in relation to Acceptable Use and the Privacy Policy.

1.5. "Privacy Policy" means the O2 privacy policy which is available at [www.O2.ie/terms].

1.6. "O2" means Telefónica O2 Ireland Limited having its registered and principle place of business at 28-29 Sir John Rogersons Quay, Dublin 2.

1.7. "O2 Forum" means the O2 customer forum at [web address].

1.8. "O2 Forum Guidelines" means any general guidelines explaining the terms of use of the O2 Forum and which, for the avoidance of doubt, shall be read together with, not in substitution for, these terms and conditions and the General Terms.

2. Minors

2.1. The O2 Forum is restricted to persons aged 13 years or over. By accepting these terms and conditions the Customer confirms he/she is aged 13 years or over. O2 reserves the right at any time to verify the eligibility of participants in the O2 Forum.

3. Content

3.1. Customer shall not submit any Content to the O2 Forum that does not comply with these terms and conditions and/or the General Terms and/or the O2 Forum Guidelines.  In addition, and for the avoidance of doubt, the Customer shall not submit to the O2 Forum any Content, which in the absolute and sole discretion of O2 is deemed by O2 to be:-

3.1.1. in contravention of any relevant local, national or international law or which incites or encourages the contravention of any such law;

3.1.2. is racist, sexist or homophobic;

3.1.3. is pornographic, obscene, profane, vulgar, or contains swearing (including words which use * or any other symbol instead of a letter contained in a word);

3.1.4. is defamatory of any person, entity or organisation whether directly or by implication;

3.1.5. is in any way abusive, threatening or otherwise likely to be harmful to those persons that use or are likely to use the O2 Forum;

3.1.6. in breach of the technical requirements of the O2 Forum;

3.1.7. is otherwise offensive;

3.1.8. infringes the rights (including but not limited to the intellectual property rights) of any person;

3.1.9. relates to the conduct of a business;

3.1.10. includes advertising, or is soliciting business whether directly or indirectly;

3.1.11. impersonates, or attempts to impersonate another person, whether or not that person is a user of the O2 Forum;

3.1.12. infringes the privacy of an individual or company, including (but not limited to) posting location and/or contact details of another person;

3.1.13. encourages, promotes or facilitates or in any way whatsoever relates to the illegal use of software.

3.1.14. encourages, promotes or facilitates or in any way whatsoever relates to the illegal breach of Terms and Conditions.

4. Moderation.

4.1. The O2 Forum is moderated and to enable moderation all Content must be in English only.

4.2. O2 may review the Content submitted by the Customer to the O2 Forum for suitability and for compliance with these terms and conditions and the General Terms and the O2 Forum Guidelines whether prior to or after the Content has been posted on the O2 Forum.  

4.3. O2 expressly reserves onto itself in its absolute and sole discretion the absolute right to reject or accept Content at any time and for any reason whatsoever. Further, O2 may at any time and for any reason whatsoever and without notice or liability to Customer:-

4.3.1. remove Content from the O2 Forum whether permanently or temporarily;

4.3.2. destroy any Content; and

4.3.3. terminate Customer access to the O2 Forum whether permanently or temporarily.

4.4. Before posting Content which contains an image of another person(s); an image of property owned by a person other than the person posting the Content; and/ or reference to another person sufficient to identify them (either alone, or in combination with any other Content), the Customer must obtain that other person's consent prior to posting the Content.  O2 reserves the right at any time to request any such evidence of consent as it sees fit and, without prejudice to Clause 4.3 above, to withhold posting of Content until satisfactory evidence of consent to posting is forthcoming.

4.5. O2 reserves the right to report to the relevant authorities any Content which it believes to be illegal.

5. Ownership and Licence of Content

5.1. O2 does not claim ownership of any Content the Customer may submit or make available via the O2 Forum and the Customer shall continue to own all rights in such Content and have the right to use such Content in any way Customer may choose. However, by submitting to or making available any Content on the O2 Forum Customer agrees to grant O2 a perpetual, royalty-free, irrevocable, non-exclusive, sub-licensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, make available to the public (on the O2 Forum or elsewhere), and exercise all copyright and publicity rights with respect to Content worldwide and/or to incorporate the Customer contribution in other works in any media now known or later developed for the full term of any rights that may exist in the Customer Content as O2 may require. By submitting or making available any Content to the O2 Forum, the Customer also hereby agrees to waive and does hereby waive all moral rights in that Content. O2 may at any time without notice to the Customer, grant the same or other rights in respect of the Customer Content to third parties without payment to the Customer and sell, distribute or otherwise publish the Customer Content outside of the O2 Forum.

6. Severability

6.1. If any provision of these terms and conditions is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.

7. Privacy Policy and Data Protection Consent

7.1. Information which the Customer provides to O2 as part of the O2 Forum and other information which the Customer may supply to O2 is subject to the Privacy Policy.

7.2. The current version of the Privacy Policy hall be deemed incorporated into these terms and conditions.

7.3. In addition to the terms set out in the Privacy Policy, the Customer is hereby notified that the Customer data will not be shared with, sold or distributed to any third parties, unless:

7.3.1. O2 has the Customers consent to do so (either under the Privacy Policy or with the Customers express consent from time to time);

7.3.2. O2 is required to do so by law;

7.3.3. O2 believes it is necessary to protect the rights or property of O2, a customer or a member of the public; or

7.3.4. a third party is acting on behalf of O2 (which may include third party service providers based in a jurisdiction which does not treat data as securely as data is treated in Ireland).

8. General

8.1. These terms and conditions shall be governed by and construed in accordance with Irish Law. Both the Customer and O2 hereby submit to the exclusive jurisdiction of the Irish courts.

8.2. O2 reserves the right to review and revise its terms and conditions from time to time without giving the Customer prior notice and by using the O2 Forum subsequent to any revision of our terms and conditions, the Customer hereby agrees to be bound by such changes.
